New York City has imposed additional restrictions on the information employers can ask on employment applications. As of October 31, 2017, the New York City Human Rights Law will prohibit all NYC employers from inquiring into and/or relying upon the salary history of an applicant during the hiring process (with some limited exceptions). This restriction includes questions on employment applications and during the interview process. Therefore, before October 31st, NYC employers should review their employment applications to remove any questions regarding salary history. In addition, all interviewers should refrain from asking questions about salary history. Finally, any internet searches or background checks should exclude salary history inquiries.
